Collection and Use of Personal Information
On our Website, personal information collected by JLR Canada is used for four main purposes. First, we collect information to enable the features of the Website. Second, we collect information to improve the Website by determining which of our products, features and services are most popular. Third, we may now or in the future collect information to personalize the experience of the users of the Website. Finally, we collect information to communicate with you and to inform you about JLR Canada’s and third parties’ products, services and events.

– provide you with services you request and respond to your comments, concerns
or requests for information;
– assist our retailers to meet your automotive product and services needs such as providing
you with offers, service reminders, marketing programs or promotional materials; and
– provide you with offers and information about related automotive products offered by others
which we think may be of interest to you.
We may also collect, use, and disclose personal information to meet our legal obligations, assist in law enforcement purposes, and protect the business interests of JLR Canada and our customers.
The types of personal information JLR Canada collects may include (1) names; (2) mailing addresses; (3) e-mail addresses; (4) biographical information such as household data, preferences, and demographic information; (5) home and/or mobile telephone numbers; (6) drivers’ license numbers; (7) purchase information regarding our products and services; (8) vehicle identification numbers (VINs); (9) information about your vehicle, such as applicable vehicle incentives, new or used, lease or purchase, any trade-in, odometer reading, make, model, model year and options, recalls, and customer notification programs, and whether you have disposed of a Land Rover or Jaguar vehicle; (10) information about your vehicle service, including warranty and paid repair data and extended service plan or Roadside Assistance for your vehicle; (11) information you provide us about you and your purchase, lease or service experience and competitive vehicle ownership; (12) financial and credit information about you shared with us by JLR Canada’s financial service providers; and (13) other personal information you choose to submit.
The means by which JLR Canada collects such personal information may include: (1) when you purchase, order, or request information about our products and services through the Website or through other means; (2) when you access a JLR Canada social media platform; (3) when you sign up for e-mail notifications, electronic newsletters, or social media notifications from, or on behalf of, JLR Canada; (4) when you enter or participate in a JLR Canada contest, event, promotion or sweepstakes, or respond to one of our surveys; (5) when you provide JLR Canada with comments, suggestions or other input through the Website; (6) when you create a user account for use in connection with the Website (your “User Account”); (7) from financial service providers when you lease or purchase a vehicle from us and where you have provided your consent, the financial service providers provide us with your contact information and information about your finance or lease contract so that we may offer you automotive or financial services products that may be of interest to you; (8) when you acquire a new or pre-owned vehicle from one of our retailers, or obtain vehicular service from one of our retailers, the retailer provides us with information about you and your vehicle, such as your name and contact information, VIN and vehicle details, service history, any trade-in, lease or applicable incentive information, and service coverage plan; (9) when you call our Customer Relations Centre (CRC), or when we call you, it is our general practice to monitor and/or record such calls for staff training and quality assurance purposes; and (10) when you otherwise choose to provide us or one of our retailers with personal information. JLR Canada also collects such personal information in our marketing efforts on third party websites. JLR Canada may purchase such personal information from reputable third party vendors who provide us with reasonable assurances as to their compliance with applicable privacy laws, including the collection of consents required thereunder.
To ensure our database addresses remain accurate, we also obtain address information from third party licensed data providers and other authorized parties.
JLR Canada or a partner may sponsor promotions, sweepstakes or contests through the Website. Your participation is entirely voluntary. Users may be asked to provide personal information including, among other things, name, email address or home address or to answer questions in order to participate.
Additional Ways that Information is Collected
Browser Log Files
Our servers automatically log each visitor to the Website and collect and record certain information about each visitor. We use this information to perform analytics on user experience while using the Website and to improve the functionality of our Website to better meet user wants and needs. This information includes or may include your “Internet Protocol”, or IP, address, browser language, browser type, operating system, domain names, browsing history (including time spent at a domain, time and date of your visit), referring/exit web pages and URLs, and number of clicks. The domain name and IP address reveal nothing personal about the user other than the IP address from which the user has accessed the Website.
Some of our web pages and electronic communications may contain images, which may or may not be visible to you, known as Web Beacons (sometimes referred to as “clear gifs”). Web Beacons collect only limited information that includes a cookie number; time and date of a page view; and a description of the page on which the Web Beacon resides. We may also carry Web Beacons placed by third party advertisers. We may assign you a unique internal identifier to help keep track of your future visits. We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Website and some of the electronic communications you receive from us. Third Party Opt Out
We may allow third-party companies to serve advertisements and/or collect certain anonymous information when you visit the Website. When Information Is Disclosed By JLR Canada

Personal information you provide to us is only available to persons within our organization who require it in order to carry out the purposes described to you. Personal information we collect is maintained with the source of the information in Jaguar Land Rover’s database, located in Ireland.
We may share personal information with our financial service providers that we may retain from time to time, who may use this information to contact you regarding the administration of your lease and for marketing purposes.
We may share non-personally identifiable information (such as anonymous user usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to demonstrate the usage patterns for JLR Canada’s advertisements, content, functionality promotions and/or services on the Website and/or on third party websites.

User Account, Password, and Security
For certain features available through the Website, we may require the use of encryption technologies provided for your protection and/or User Account. - insurance policy number and details about insurance coverage;

- Social insurance number and/or the social insurance number of other members of your family;
Please Note: Provision of your Social Insurance Number is optional. However, you should be aware that most credit reporting agencies use the Social Insurance Number as a unique identifier to ensure proper identification when conducting credit reviews and preparing credit reports. If you do not wish to provide your Social Insurance Number, our ability to obtain a timely and accurate credit report may be affected.

Technical Information We Collect Automatically
When you visit the Sites, we may collect, using electronic means, technical information. This information may include:

4. Disclosure of Personal Information
Birchwood may disclose your personal information to:
- its employees, agents, affiliates, subsidiaries, partners, and service providers as is reasonably necessary to enable these parties to perform a business, professional or technical support function for Birchwood. Service providers may include those who provide satellite radio services in some vehicles, vehicle protection products, and other vendors that provide data hosting, marketing and promotional administration assistance, and customer service surveys and initiatives;
- motor vehicle manufacturers in connection with the provision of the Service;
- a person who, in the reasonable judgment of Birchwood, is seeking the information as your agent; and
- a third party or parties, where you consent to such disclosure or the disclosure is permitted or required by law. For example, to prevent potential harm to it, its customers, or the public, in connection with a government inquiry or law enforcement activities, in litigation or dispute resolution, or to detect, prevent or address fraud or security issues.
Corporate Reorganization and Business Transfers
5. Change of Purpose
Birchwood will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and obtain your express consent to do so pursuant to Section 21.
Please note that we may process your personal data without your knowledge or consent where this is required or permitted by law.
The Service is intended for general audiences and is not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. In the event that we learn that we have collected personal information from a child under the age of 16, we will take appropriate steps to delete that personal information. If you become aware or believe that a child has provided us with personal information, please contact us as provided in Section 17.
7. Safeguarding Your Personal Information
Birchwood is committed to safeguarding your personal information. Birchwood uses appropriate security measures to protect personal information against risks such as loss or theft, unauthorized access, disclosure, copying, misuse, modification or destruction, and any other unlawful form of processing of the personal information in our possession regardless of the format in which it is held. The methods of protection and safeguards used by Birchwood include, but are not limited to:
- Administrative safeguards such as privacy and security policies and procedures, privacy and data protection training for Birchwood staff;
- Technical safeguards such as security testing, vulnerability scans, and technological measures, including the use of passwords, encryption, firewalls, and secure coding frameworks;
- Physical safeguards such as locked filing cabinets, and need-to-know access for Birchwood employees.
Birchwood also ensures that its employees with access to personal information are made aware of the importance of maintaining the confidentiality of personal information.
Birchwood takes care in disposing of or destroying personal information to prevent unauthorized parties from gaining access to the information.
8. Cross Border Transfer of Personal Information
Your personal information may be stored and processed in any country where we engage third party service providers (e.g. Canada, United States, and/or Europe). While such information is outside of your country of residence, it is subject to the law of the country in which it is held, and may be subject to disclosure to the governments, courts, or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. For example, personal information stored in the United States is subject to the US PATRIOT ACT.
Where and when appropriate, we will transmit amended personal information to third parties having access to the personal information in question.
9. Retention of Personal Information
Birchwood will only keep personal information for as long as reasonably necessary to fulfil the relevant purposes set out in the Policy Privacy and in order to comply with our legal and regulatory obligations. To determine the appropriate retention period for your information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information and whether we can achieve those purposes through other means, and the applicable legal requirements.
10. Non-Personal Information
We may collect, use and disclose non-personal information, including aggregated data resulting from the combination and/or aggregation or certain raw data collected from you with other data in a way that no longer personally identifies you. We make no attempt to link this non-personal information with the identity of individuals. We may permanently archive non-personal information for future use in any manner whatsoever.
11. Accuracy of Personal Information
Birchwood is committed to keeping your personal information as complete, up-to-date and accurate as is necessary for the purposes for which it is to be used. Birchwood will promptly correct or complete any personal information found to be inaccurate or incomplete.
12. Access to Personal Information
Upon request, Birchwood will provide you with a reasonable opportunity to review the accuracy of your personal information. Such personal information will be provided within a reasonable time of the request and at a minimal or no cost to you.
Also upon request, Birchwood will provide an account of the use and disclosure of your personal information and, where reasonably possible, will state the source of the information. In providing an account of disclosure, Birchwood will provide a list of organizations to which it may have disclosed personal information about you when it is not possible to provide an actual list.
In certain situations, Birchwood may not be able to provide access to all of the personal information we hold about you. In such a case, we will provide the reasons for denying access upon request. Such reasons may include:
- if doing so would likely reveal personal information about another individual that cannot be severed or the information could reasonably be expected to threaten the life or security of another individual;
- if doing so would reveal any of our confidential information;
- if the information is protected by solicitor-client privilege;
- if the information was generated in the course of a formal dispute resolution process; or
- if the information was collected in relation to the investigation of a breach of an agreement or a contravention of a federal or provincial law, or that of a foreign jurisdiction.
13. Cookies and Similar Technologies
The Sites use “cookies”, which are small text files placed on your computer or other device when you visit a website. When you visit the site again, the cookie allows that site to recognize your browser. Cookies may store user preferences and other information.
There are three main types of cookies:
