PRIVACY POLICY

We respect and are committed to protecting your privacy. That is why we have adopted this Privacy Policy. This Privacy Policy lets you know how and for what purposes your personal information is being collected, processed and used. We pledge that we will take reasonable steps to ensure that your personal information will only be used in ways that are in compliance with this Privacy Policy.

This Privacy Policy is only in effect for user-specific information and personal information collected and/or owned by Jaguar Land Rover Canada, ULC (“JLR Canada”, “our” or “we”), and, without limitation, applies to the Jaguar Canada and the Land Rover Canada websites, as well as any online features, services and/or programs, mobile applications, third party social media sites and e-mail lists offered by JLR Canada (collectively, the “Website”).

This Privacy Policy is not applicable to any other web pages, mobile applications, third party social media sites or e-mail lists, or any user-specific information or personal information collected and/or owned by any entity other than JLR Canada, including, but not limited to, Tata Motors, Jaguar Land Rover Limited, Jaguar Land Rover North America, LLC, and any automobile retailer or service centre. Users of the foregoing resources should refer to the Privacy Policy in effect for the applicable owner.

Your use of the Website is also governed by Terms and Conditions located at http://www.landrover.com/ca/en/lr/terms-and-conditions/terms-and-conditions/

We will make an effort to update this web page with any changes to this Privacy Policy and you are encouraged to review this Privacy Policy frequently (the date of the most recent revision to this Privacy Policy appears at the end of this Privacy Policy).

By using this Website you consent to the terms of this Privacy Policy and our Terms and Conditions. If you do not agree with any terms of this Privacy Policy or our Terms and Conditions, please do not use this Website or submit any personal information.

As used in this Privacy Policy, “personal information” means any information about an identifiable individual.

Collection and Use of Personal Information

On our Website, personal information collected by JLR Canada is used for four main purposes. First, we collect information to enable the features of the Website. Second, we collect information to improve the Website by determining which of our products, features and services are most popular. Third, we may now or in the future collect information to personalize the experience of the users of the Website. Finally, we collect information to communicate with you and to inform you about JLR Canada’s and third parties’ products, services and events.

We may also collect and use personal information for other purposes which are disclosed to you, and to which you consent, or to meet our legal obligations. For example, we may collect and use personal information to:

– establish, maintain and improve our customer relationship with
you and provide you with offers, incentives, marketing programs or promotional material
about us and our automotive products and services, such as brochures and newsletters;
– more effectively market to you our vehicles, vehicle parts, accessories and services by
better understanding your automotive product and service needs and preferences;
– improve the automotive products and services we offer through customer surveys
conducted by us and participation in market research studies conducted by third parties;
– assist in administering your vehicle purchase, lease, warranty, any extended service plan,
Roadside Assistance, or ongoing vehicle service, including advising you of any product
recalls or customer notifications with respect to your vehicle, arranging for JLR Canada
retailers to obtain required vehicles and parts on a timely basis to meet your needs;
– provide you with services you request and respond to your comments, concerns
or requests for information;
– assist our retailers to meet your automotive product and services needs such as providing
you with offers, service reminders, marketing programs or promotional materials; and
– provide you with offers and information about related automotive products offered by others
which we think may be of interest to you.

We may also collect, use, and disclose personal information to meet our legal obligations, assist in law enforcement purposes, and protect the business interests of JLR Canada and our customers.

The types of personal information JLR Canada collects may include (1) names; (2) mailing addresses; (3) e-mail addresses; (4) biographical information such as household data, preferences, and demographic information; (5) home and/or mobile telephone numbers; (6) drivers’ license numbers; (7) purchase information regarding our products and services; (8) vehicle identification numbers (VINs); (9) information about your vehicle, such as applicable vehicle incentives, new or used, lease or purchase, any trade-in, odometer reading, make, model, model year and options, recalls, and customer notification programs, and whether you have disposed of a Land Rover or Jaguar vehicle; (10) information about your vehicle service, including warranty and paid repair data and extended service plan or Roadside Assistance for your vehicle; (11) information you provide us about you and your purchase, lease or service experience and competitive vehicle ownership; (12) financial and credit information about you shared with us by JLR Canada’s financial service providers; and (13) other personal information you choose to submit.

The means by which JLR Canada collects such personal information may include: (1) when you purchase, order, or request information about our products and services through the Website or through other means; (2) when you access a JLR Canada social media platform; (3) when you sign up for e-mail notifications, electronic newsletters, or social media notifications from, or on behalf of, JLR Canada; (4) when you enter or participate in a JLR Canada contest, event, promotion or sweepstakes, or respond to one of our surveys; (5) when you provide JLR Canada with comments, suggestions or other input through the Website; (6) when you create a user account for use in connection with the Website (your “User Account”); (7) from financial service providers when you lease or purchase a vehicle from us and where you have provided your consent, the financial service providers provide us with your contact information and information about your finance or lease contract so that we may offer you automotive or financial services products that may be of interest to you; (8) when you acquire a new or pre-owned vehicle from one of our retailers, or obtain vehicular service from one of our retailers, the retailer provides us with information about you and your vehicle, such as your name and contact information, VIN and vehicle details, service history, any trade-in, lease or applicable incentive information, and service coverage plan; (9) when you call our Customer Relations Centre (CRC), or when we call you, it is our general practice to monitor and/or record such calls for staff training and quality assurance purposes; and (10) when you otherwise choose to provide us or one of our retailers with personal information. JLR Canada also collects such personal information in our marketing efforts on third party websites. JLR Canada may purchase such personal information from reputable third party vendors who provide us with reasonable assurances as to their compliance with applicable privacy laws, including the collection of consents required thereunder.

We may collect a list of names and addresses, which may include your name and address where you have given your consent, from list vendors to send promotions or product information to the names on the list. We also have relationships with third parties with whom we conduct joint marketing activities such as contests through which we may obtain your name and address and other information about you with your consent. These activities clearly identify the other parties involved and provide information about their privacy practices. Any such other parties are bound by their privacy policy, not ours, unless they specifically inform you that they agree to comply with this policy (in any case ensuring their compliance with this policy is not JLR Canada’s responsibility).

To ensure our database addresses remain accurate, we also obtain address information from third party licensed data providers and other authorized parties.

JLR Canada or a partner may sponsor promotions, sweepstakes or contests through the Website. Your participation is entirely voluntary. Users may be asked to provide personal information including, among other things, name, email address or home address or to answer questions in order to participate.

Additional Ways that Information is Collected

Browser Log Files

Our servers automatically log each visitor to the Website and collect and record certain information about each visitor. We use this information to perform analytics on user experience while using the Website and to improve the functionality of our Website to better meet user wants and needs. This information includes or may include your “Internet Protocol”, or IP, address, browser language, browser type, operating system, domain names, browsing history (including time spent at a domain, time and date of your visit), referring/exit web pages and URLs, and number of clicks. The domain name and IP address reveal nothing personal about the user other than the IP address from which the user has accessed the Website.

Cookies

From time to time, JLR Canada and/or our advertisers or other third parties may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive and that can be re-sent to the serving website on subsequent visits. A cookie, by itself, cannot read other data from your hard disk or read other cookie files already on your computer. A cookie, by itself, does not damage your system. We, our advertisers and other third parties may use cookies to identify and keep track of, among other things, those areas of the Website and third party websites that you have visited in the past in order to enhance your next visit to the Website or, in the case of our third party advertiser Xaxis, Inc., to provide you with online advertising and to customize the sort of advertisements it provides you. You can choose whether or not to accept cookies by changing the settings of your Internet browser, but some functionality of the Website may be impaired or not function as intended. See the Third Party Opt Out section below.

Web Beacons

Some of our web pages and electronic communications may contain images, which may or may not be visible to you, known as Web Beacons (sometimes referred to as “clear gifs”). Web Beacons collect only limited information that includes a cookie number; time and date of a page view; and a description of the page on which the Web Beacon resides. We may also carry Web Beacons placed by third party advertisers. These Web Beacons do not carry any personal information and are only used to track usage of the Website and activities associated with the Website. See the Third Party Opt Out section below.

Unique Identifier

We may assign you a unique internal identifier to help keep track of your future visits. We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Website and some of the electronic communications you receive from us. We keep this information for our internal use, and this information is not shared with others.

Third Party Opt Out

We may allow third-party companies to serve advertisements and/or collect certain anonymous information when you visit the Website. These companies may use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to the Website in order to provide advertisements about goods and services likely to be of greater interest to you. These companies typically use a cookie or third party Web Beacon to collect this information, as further described above. Through these technologies, the third party may have access to and use non-personalized information about your online usage activity.

You can opt-out of our online behavioral services through any one of the ways described below (you don’t need to go to each opt-out site, one is sufficient). After you opt-out, you will continue to receive online advertisements, but those advertisements will no longer be as relevant to you.

– You can opt-out via the following link
http://joinlandrover.landrover.ca/STF_Unsub/landrover/en/index_unsub.html
– You can configure your web browser to delete and/or control the use of cookies. More
information can be found in the Help system of your browser. It is at your discretion
whether you use the opt-out described above or manage cookies via the browser.

Note: If you opt-out as described above, you should not delete your cookies. If you delete your cookies, you will need to opt-out again.

Collection, use and disclosure of your personal information by the retailer(s) will be subject to the retailer´s privacy policy.

We may share personal information with our financial service providers that we may retain from time to time, who may use this information to contact you regarding the administration of your lease and for marketing purposes.

We may share non-personally identifiable information (such as anonymous user usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to demonstrate the usage patterns for JLR Canada’s advertisements, content, functionality promotions and/or services on the Website and/or on third party websites.

We also reserve the right to disclose personal information and/or non-personally-identifiable information in connection with the enforcement of our Terms and Conditions located at Jaguar http://www.jaguar.co.uk/terms-conditions.html and Land Rover http://www.landrover.com/ca/en/lr/terms-and-conditions/terms-and-conditions/, take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Website, and to protect the rights, property, or personal safety of JLR Canada, our users or others.

Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties (including other users of the Website) that receive any of the information that is disclosed to us. The Website also links to a wide variety of other websites and the Website may contain advertisements of third parties. We are not and cannot be responsible for the privacy policies of those websites of third parties or how they treat information about their users.

For certain features available through the Website, we may require the use of encryption technologies provided for your protection and/or User Account. We use reasonable precautions to protect the privacy of your UserID, password and User Account information. You, however, are ultimately responsible for protecting your UserID, password and User Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies.
You agree to: (a) immediately notify JLR Canada of any unauthorized use of your UserID, password and/or User Account, and/or any other breach of security; and (b) ensure that you exit from your User Account at the end of each session. While we may provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that information transmitted through the internet is secure, or that such transmissions are free from delay, interruption, interception or error.

Employment Opportunity Information Collection

For individuals interested in job opportunities with JLR Canada, the Website links prospective employees to a partner’s website. Furthermore, even where your personal information is to be disclosed and used in accordance with the stated purposes in this Privacy Policy, you may elect to opt out of such disclosure to and use by a third party that is not acting as an agent of JLR Canada. There are some uses from which you cannot opt-out, such as our use of your personal information in connection with your ownership status of a vehicle or vehicle recall (and similar) notification procedures.

Please note that opting out of the disclosure and use of your personal information as a prospective employee may prevent you from being hired as an employee by JLR Canada to the extent you are using this Website to apply for an open position.

If JLR Canada collects personal information, such information will not be disclosed or used by JLR Canada for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization unless you affirmatively consent to such disclosure and use.

Your use of the Website following any amendment of this Privacy Policy will signify your assent to and acceptance of its revised terms for all previously collected information and information collected from you in the future. We may use comments, information or feedback that you may submit in any manner that we may choose without notice or compensation to you.

13. Cookies and Similar Technologies

The Sites use “cookies”, which are small text files placed on your computer or other device when you visit a website. When you visit the site again, the cookie allows that site to recognize your browser. Cookies may store user preferences and other information.
There are three main types of cookies:

  1. Session cookies are specific to a particular visit and limited to sending session identifiers (random numbers generated by the server) so you do not have to re-enter information when you navigate to a new page or check out. Session cookies are not permanently stored on your device and are deleted when the browser closes;
  2. Persistent cookies record information about your preferences and are stored in your browser cache or mobile device and remain on your device between browsing sessions. For example, a persistent cookie may be used on a website to remember your log-in details so you will not need to enter those details each time you visit that website; and
  3. Third party cookies placed by someone other than us which may gather data across multiple websites or sessions.

We use the below listed cookies to perform the following functions:

  1. Strictly necessary / technical cookies that are essential to enable you to move around a website and use its features. You cannot withdraw your consent to the use of these types of cookies because without them, the Service cannot be provided.
  2. Analytical / performance cookies that collect information in aggregated form about how users interact with the Sites so that we may improve functionality. These cookies are sometimes placed by third party providers which enable features or functionality provided by third parties in connection with the Service. For example, advertising, interactive content, and analytics (see Section 16 below). The parties that set these third-party cookies can recognize your device both when it visits the website in question and also when it visits certain other websites.
  3. Functional cookies that allow a website to remember choices you make, recognize you when you return and to personalize content.
  4. Targeting / advertising cookies that track browser habits and used to deliver targeted (interest-based) advertising based on your browsing activities and interests. See Section 15 on how you may opt out of targeting advertising.

You acknowledge that where we allow third parties to drop cookies, we have no control over those cookies or the data generated. Please refer to the third party’s privacy policy for information on what information they collect and how they use it. These cookies are likely to be analytical/performance cookies or targeting cookies.

Other Technologies

We may use other technologies similar to cookies like web beacons, which are sometimes called “tracking pixels” or “clear gifs”. These are tiny graphics files that contain a unique identifier that enable us to recognize when someone has visited the Sites or opened an email that we have sent them. In many instances, these technologies are reliant on cookies to function properly, and so declining cookies will impair their functioning.

Right to Refuse the Use of Information Collection Technologies

We obtain your consent to our information collection technologies through our opt-in mechanism on the Sites. You have the right to object to the use of information collection technologies such as cookies. Regular cookies may generally be disabled or removed by tools that are available as part of most commercial browsers, and in some but not all instances can be blocked in the future by selecting certain settings. Each browser you use will need to be set separately and different browsers offer different functionality and options in this regard.

Please be aware that if you disable or remove these technologies you may find that certain functions and features will not work as intended on the Service and that when you revisit our website your ability to limit cookies is subject to your browser settings and limitations.

14. Links to Other Websites

The Sites may contain links to other sites, such as social media platforms (e.g. Facebook, Instagram, YouTube, Twitter, and LinkedIn) and motor vehicle manufacturers. The Privacy Policy only applies to personal information that we collect, use and disclose. We are not responsible or liable for the privacy practices of third parties, and we strongly recommend that you review their privacy policies before you disclose personal information to them.

15. Targeted Advertising and How You May Opt Out

We may use third party advertising partners such as advertising networks, exchanges, and social media platforms to display advertising on the Sites or to manage and serve our advertising on other sites. You have a variety of options to opt out of interest based advertising ranging from browser controls, add on utilities such as ad blockers, and other opt out tools. Opt out tools may include organizations such as:

  • Network Advertising Initiative: https://optout.networkadvertising.org/?c=1,;
  • Digital Advertising Alliance (“DAA”) of Canada: https://youradchoices.ca/;
  • DAA YourAdChoices: https://youradchoices.ca/en/tools.

16. Analytics

The Sites employ Google Analytics, a web analysis service from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies,” which are text files placed on your computer, to help the website analyze how users use the Sites, compiling reports on the Sites’ activity for the Sites’ operators and providing other services relating to website activity and Internet usage. The information generated by the cookie (including the IP address) is transferred and stored on a Google server located in the United States.

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other information held by Google.

We may also use additional analytics programs from time to time to process non-personal information about you.

We make no attempt to link this non-personal information with the identity of individuals using the Service. Non-personal information may be permanently archived for future use in any manner whatsoever by Birchwood.

Disable Google Analytics

You can prevent the collection and processing of cookie created data relating to your utilization of the Sites (including your IP) via Google by downloading and installing the browser-plugin available under the following link (https://tools.google.com/dlpage/gaoptout?hl=en).

Google currently offers this opt-out tool for Internet Explorer 11, Google Chrome, Mozilla Firefox, Apple Safari and Opera.

Further information concerning the terms and conditions of Google’s use and data privacy can be found at https://www.google.com/analytics/terms/us.html or at https://policies.google.com/privacy.

21. Privacy Policy Changes

We may modify the Privacy Policy to accommodate changes in our services, changes in technology and legal developments. If we make changes to the Privacy Policy, we will provide notice through the Service, or by other means to provide you the opportunity to review the changes before they become effective. For example, we may place a prominent notice on the Sites or e-mail you to let you know of an updated Privacy Policy.

If we make significant changes to the Privacy Policy, we will provide at least 30 days’ notice through the Service, or by other means, to provide you the opportunity to review the changes and provide your required consent before they become effective. A significant change may be using personal information for a new purpose or disclosures to new third parties.
